Terms and Conditions

These Terms and Conditions ("Terms") govern your access to and use of the From the Crease mobile application, website, and platform (collectively, the "Platform"), operated by FTC Sports Media LLC ("FTC Sports Media," "we," "us," or "our").

By downloading, accessing, or using the Platform, you agree to comply with and be bound by these Terms. If you do not agree, you must not use the Platform.

The App is intended for use by goaltenders of all ages, including minors, often through participation in a hockey Organization.

As a matter of global company policy, if you are under the age of 16 — regardless of your location, and regardless of any lower age threshold that might otherwise apply under local law — you may only create an account or use any feature involving communication, content access, or user interaction after we have verified the consent of a parent or legal guardian, consistent with our Privacy Policy.

Certain Services may be provided through hockey associations, clubs, leagues, academies, or other hockey-related organizations ("Organizations").

Organizations may purchase subscriptions through FTC Sports Media LLC and provide access to authorized users, including coaches, athletes, instructors, and other participants.

If your account is provided through an Organization:

● Your access to certain Services may be managed through that Organization.
● The Organization may provide FTC Sports Media with information necessary to create and administer user accounts.
● Your access may end if your relationship with the Organization ends, if the Organization removes your access, or if the Organization's subscription expires.
● Organization accounts and access are provided solely for authorized users and may not be shared, transferred, or resold.

Organizations are responsible for ensuring they have the appropriate authority and permissions to provide user information to FTC Sports Media and to enroll users in the Services. Where an Organization provides FTC Sports Media with personal information about a user who is under 16, the Organization is responsible for first obtaining and documenting any required parent or guardian consent, and represents to FTC Sports Media that it has done so.

Authorized Organization administrators may assist with user administration and account management. Subscription purchases, seat allocation, seat adjustments, and billing changes are managed through FTC Sports Media LLC.

All content within the Platform, including text, videos, images, graphics, designs, trademarks, and logos, is the property of FTC Sports Media LLC or its licensors and is protected by copyright and other intellectual property laws.

You may not copy, distribute, reproduce, modify, publicly display, or create derivative works based on any content from the App without our prior written consent.

Use of the Platform does not grant you any ownership rights in the content or intellectual property available through the Services.

Users may capture screenshots or recordings for personal, non-commercial use, including sharing with other individuals.

All Platform content, including videos, audio, images, drills, graphics, text, screenshots, recordings, and related materials, remains the property of FTC Sports Media LLC or its licensors.

Users may not publish, sell, license, sublicense, monetize, modify, create derivative works from, or otherwise commercially exploit App content without FTC Sports Media LLC's prior written consent.

Platform content may not be used to train, test, develop, or improve any artificial intelligence, machine learning, or similar automated system, regardless of purpose.

FTC Sports Media LLC may suspend or terminate access and pursue available remedies for any unauthorized use of Platform content.

The Platform includes goaltending-related educational materials such as training advice, drills, videos, and instructional content (collectively, "Coaching Content").

This material is provided for educational and informational purposes only.

By using the Coaching Content, you acknowledge and agree that participation in physical activity involves inherent risks.

FTC Sports Media LLC is not responsible for any injury, loss, death, or damage that results from the use or misuse of Coaching Content provided through the Platform. Nothing in this Section limits liability for death or personal injury caused by our negligence, or for any other liability that cannot be excluded under applicable law (see Section 11A).

Any coaches, contributors, or third parties featured in the App are independent and not necessarily endorsed or vetted by FTC Sports Media.

You agree to use the Platform for lawful purposes only.

You must not:

● Use the Platform in any way that could damage, disable, overburden, or impair our servers or networks.
● Attempt to gain unauthorized access to any portion of the Platform, accounts, systems, or networks.
● Engage in conduct that interferes with another user's experience.
● Upload, share, or distribute harmful, abusive, or unlawful content through any in-app communication features.
● Share account credentials or allow unauthorized users to access your account.
● Attempt to bypass subscription restrictions, access paid content without authorization, or interfere with the operation of the Services.

Any feedback or communication exchanged between a coach and an athlete through the App is automatically moderated to help maintain a safe environment. Where moderation identifies an immediate safety risk, we may take automated action right away, such as pausing a conversation or alerting our safety team, to contain the risk. Any suspension, termination, or other punitive action taken against your account as a result of moderation is reviewed by a person before it is finalized.

If the athlete is under 16, the athlete's verified parent or guardian will receive a weekly transcript or summary of the feedback exchanged between the coach and the athlete, for transparency, accountability, and safety. By using the App to communicate with an athlete you know or should know is under 16, you acknowledge and agree that such communications will be moderated and made available to that athlete's verified parent or guardian on this basis.

Either a coach or an athlete may block the other party at any time, which immediately ends further communication between them. Blocking does not retract a transcript already delivered to a guardian and does not shorten the retention period that otherwise applies to the underlying moderation records for that connection.

Subscription Purchases

The App may offer paid subscriptions, including individual subscriptions and Organization subscriptions.

When you purchase a subscription within the App, you agree to pay all applicable fees associated with that subscription.

Individual subscriptions purchased through the App are processed through Apple App Store or Google Play Billing, and are subject to the payment terms and policies of those platforms.

Organization subscriptions are purchased directly through FTC Sports Media LLC and are subject to the applicable subscription agreement, pricing, and payment terms provided by FTC Sports Media LLC.

Organization subscriptions provide access to a defined number of authorized users or seats.

Organization seats are owned by the purchasing Organization and may not be transferred, resold, or assigned outside of the Organization without approval from FTC Sports Media LLC.

Subscription terms, seat allocations, and billing arrangements are managed through FTC Sports Media LLC.

Auto-Renewal

Some subscriptions may renew automatically unless canceled before the renewal date.

For subscriptions purchased through Apple App Store or Google Play, auto-renewal settings must be managed through your Apple or Google account settings.

Organization subscription renewals, cancellations, and billing changes are managed through FTC Sports Media LLC.

Refunds and Cancellations

Refunds for subscriptions purchased through Apple App Store or Google Play are processed according to the refund policies of those platforms.

Users must request refunds directly through the applicable platform.

Organization subscription refunds, credits, or adjustments are handled according to the applicable agreement with FTC Sports Media LLC. This does not affect any statutory withdrawal or cancellation rights available to consumers under applicable EU, UK, or Swiss law, to the extent such rights apply to the relevant purchase.

Subscription Access

FTC Sports Media LLC may suspend or restrict access to paid features if subscription fees are unpaid, fraudulent activity is suspected, or these Terms are violated.

The Platform may contain links or integrations with third-party services such as payment processors, analytics platforms, or partner content.

FTC Sports Media LLC is not responsible for the content, functionality, privacy practices, or terms of use of any third-party platforms.

Accessing or using those services is at your own risk and subject to their respective policies.

FTC Sports Media LLC may suspend or terminate your access to the Platform or Services if:

● You violate these Terms.
● You misuse Platform content or intellectual property.
● You attempt to access paid features without authorization.
● Fraudulent, harmful, or unauthorized activity is suspected.
● Required subscription payments are not made.
● An Organization requests removal of access for a user associated with its account.
● Moderation of in-app communications reveals conduct that violates these Terms or raises a safety concern.

Termination or suspension may result in the loss of access to certain features, content, or account information.

The Platform and its content are provided "as is" and "as available" without warranties of any kind, express or implied.

FTC Sports Media LLC does not guarantee that the Platform will be error-free, uninterrupted, or meet your specific expectations.

We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. For consumers in the EEA, United Kingdom, or Switzerland, this disclaimer does not affect statutory rights that cannot be excluded or limited under applicable consumer protection law, including rights relating to the conformity of digital content and digital services.

To the fullest extent permitted by law, FTC Sports Media LLC shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or related to your use of the Platform, even if advised of the possibility of such damages.

Your sole and exclusive remedy for dissatisfaction with the Platform or its content is to stop using the Platform.

Nothing in Section 10 or this Section 11 excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded or limited under applicable law, including mandatory consumer-protection law applicable to users in the EEA, United Kingdom, or Switzerland.

FTC Sports Media LLC may revise or update these Terms at any time. Any changes will be posted within the App with an updated effective date. Continued use of the App after such changes constitutes your acceptance of the revised Terms.

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to conflict of law principles.

Any disputes arising under these Terms shall be resolved exclusively in the courts located in Florida, USA.

If you are a consumer habitually resident in the European Union, United Kingdom, or Switzerland, the foregoing choice of law and forum is without prejudice to any mandatory consumer-protection provisions of the law of your country of habitual residence that cannot be departed from by agreement, and nothing in this Section deprives you of the protection afforded by those provisions or of your right to bring proceedings before the courts of your place of habitual residence, to the extent required by applicable law (including Regulation (EU) No 1215/2012 and Regulation (EC) No 593/2008, or their UK/Swiss equivalents).

A. Severability

If any provision of these Terms is held to be invalid or unenforceable, that provision shall be removed or interpreted, if possible, in a manner as to be enforceable, and the remaining provisions shall remain in effect.

Headings are for reference only and do not affect interpretation.

Our failure to act with respect to a breach does not waive our right to act with respect to subsequent or similar breaches.

B. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FTC Sports Media LLC regarding your use of the App and Services.

C. No Joint Venture; No Derogation of Rights

You agree that no joint venture, partnership, employment, or agency relationship exists between you and us as a result of these Terms or your use of the Platform.

Our performance of these Terms is subject to existing laws and legal process, and nothing contained herein is in derogation of our right to comply with governmental, court, or law enforcement requests or requirements relating to your use of the App or information provided to or gathered by us with respect to such use.
